Are There Any Advantages of L-1 Visa over E-2 Visa?

Hi William,

I am looking for applying for L-1 visa or E-2 visa to work in U.S. to do business. Are there any advantages of L-1 visa over E-2 visa? What I should know more about these two visas?

Answer,

One distinct advantage of the L-1 visa is that a citizen of any country in the world can apply for L-1 visa. But an E-2 visa requires the petitioner to be a citizen of a treaty-ratified country, such as UK or Canada among others. However, India and China are not on the list of E-1 or E-2 treaty countries.

Also, unlike an E-2 visa, the L-1 visa allows for dual-intent, meaning that an individual on an L-1 status can petition for and become a legal U.S. Permanent Resident (Green Card holder), and eventually become a U.S. citizen. An executive level employee with L-1A visa can even bypass the time consuming and expensive Labor Certification process. Also, there is no 'substantial investment' requirement for the L-1 visa either.
