About the Form I-140 and Form I-485 Processing and Adjudication Delay

My Labor Certification has been approved, and I need to file the I-140 application now. Since the new Visa Bulletin for next month retrogressed heavily from my country India in the employment-based immigration, I want to know if the premium processing service for Form I-140 is still not available? and it looks like there is a long way to go to file Form I-485 application which may create problem for my H-1B extension. Am I right?

Answer:

For the I-140 and I-485 processing and adjudication, the USCIS has already posted a notice to the public. The USCIS is experiencing delays in the processing of cases. Form I-140 petitions have no opportunity for the premium processing at this time. This has been creating problem to certain H-1B extensions and change of employment.

For the I-485 applicants, the Visa Bulletin in the December will result problems for some of I-485 applicants from India and China in EB2 and EB3. The doors will be closed for a while, for those Indians and Chinese who have been trying to get approval for their long waiting of I-485 Green Card application.
