The Launch of Form I-140 Premium Processing 
Services Will not Affect the I-140/I-485 Concurrent Filing

I plan to file the I-140 and I-485 applications concurrently next week, I am not sure whether the recent launch of the I-140 Premium Processing Services will affect the I-140/ I-485 concurrent filing. Also, I want to file my I-140 petition in EB-2 category for the immigrant visa available reason, but it looks like the EB-2 is not included in the I-140 Premium Processing Services at this time.


Answer:

The launch of the I-140 Premium Processing Services will not affect the concurrent filing and you are able to continue to file I-140 and I-485 concurrently until the USCIS publishes a regulation to terminate the concurrent filing. The USCIS started taking I-140 Premium Processing Request from August 28, 2006. This Premium Processing Service will be limited to EB-3 Skilled Worker category and Professional category only.

EB-2 and EB-3 unskilled worker category that requires less than two years of experience will not be able to file the Premium Processing Services at this time. The USCIS has released a new form I-907. Any Premium Processing Services filing using the old form after August 28, 2006 will be rejected.
