For EB1-EA Petition, the Published
Papers Should be in the Peer-reviewed Journals

Dr. William:

As a post-doctor, I plan to apply for Green Card through EB1 Extraordinary Ability category. I have about 10 published papers. But only some of them are in peer-reviewed journals, the others are published in no peer-reviewed journals, conferences, and news letters. Do you think this may be a problem?

Answer:

Overall, for EB1-Extraordinary Ability petition, the published papers should be in the peer-reviewed journals. The articles published in no peer-reviewed journals, conferences or news letters are not worthless, and they may help your case in general, but the importance and impact for your petition is much smaller than the papers published in the peer-reviewed journals.

For the published papers without peer-reviewing process, you may want to explain or describe the publication requirements to let USCIS officer know the publishing criteria.
