Application If My I-140 Application Is Disapproved?

Dr. William:

Last month, I concurrently filed I-140 and I-485 applications. According to USCIS new policy for concurrently filed I-140 and I-485, what will happen for my I-485 application if I get a RFE for my I-140 application? and what will happen for my I-485 application if my I-140 application is disapproved?


Answer:

For RFE of I-140 application, if you fail to respond to I-140 RFE, or fail to meet the eligibility requirement of I-140 application after replying the RFE, the USCIS adjudicator will deny both I-140 and I-485. 

If you successfully respond to the I-140 RFE and satisfy all eligibility requirements of I-140 application, your I-140 petition will be approved, and your I-485 application may be approved or rejected, depending on the I-485 application adjudication.
